INTRODUCTION

Emirates Insurance Company will provide the insurance described in this policy and any endorsements thereto for the Insured Period as defined in this Policy, in return for the premium paid by the Policyholder named in the Policy schedule.


DECLARATION

The coverage described in the Policy is provided and underwritten by Emirates Insurance Company (hereinafter referred to as the “Company”).

The Company has relied on the information given by the Policyholder. For the Policy to be valid, all the information provided by the Policyholder must be true and complete. If there are any changes in circumstances which may affect the Policy, the Policyholder must advise the Company, as soon as is reasonably possible. The Company will not pay benefits or arrange for help if any part of Your application for this insurance, or any further changes You ask to make to this policy, are deliberately fraudulent.

This Policy is only valid if issued with a Policy Schedule. The Policy Schedule will indicate the benefits purchased. The Policyholder must read the entire Policy carefully to determine the Insured Persons’ rights and duties, and what is and is not covered. The Company has no duty to provide cover unless there has been full compliance with all sections of the Policy.


CHANGES IN CIRCUMSTANCES

This policy provides the circumstances in which You can make a claim. Whilst the home insurance cover is wide, it is not a maintenance contract and does not protect You or Your household against wear, tear or deterioration. You must contact the Company, at the contact details provided on the first page of this document within 14 days if Your address or the Sum Insured specified in Your Policy Schedule has changed.

Changes You request will only take effect after the Company agrees and issues an endorsement to the Policy.

DEFINITIONS

The words defined below will have the same meaning wherever they are shown in Your policy

Accident means a sudden, unforeseen and unexpected event caused by external, violent and visible means (but does not include any illness or disease) which results in physical Bodily Injury.

Accidental Damage Means a physical loss or damage to the property or contents. This does not include damage caused by a deliberate act of any member of Your household or any other persons. The Insured has the burden of proof to show that the damage meets this definition.

Aircraft means any device used or designed for flight, except model or hobby craft not used or designed to carry people or cargo.

Bikes/Pedal Cycles means pedal cycles designed for propulsion solely by means of human power.

Bodily Injury means an identifiable physical injury sustained during the period of insurance and caused by a sudden, unexpected and specific event excluding disease, sickness, and/or medical disorders.

Property Insured means Buildings or Contents.

Buildings means Your home, built of brick, stone or concrete, roofed with incombustible material (unless otherwise stated in the schedule), including any domestic garages and Outbuildings, swimming pools, terraces, patios, drives, footpaths, wall fences, gates and the landlord’s permanent fixtures and fittings situated as stated in the schedule.

Clothing means wearing apparel suitable for general use, as well as handbags with or without shoulder straps. "Clothing" only includes dresses, shirts, T-shirts, pants, shorts, blouses, pullovers, sweaters, sweatpants, and skirts; bathing suits and caps; belts and suspenders; boots; coats and jackets; formal wear; garters and garter belts; girdles; gloves and mittens for general use; hats and caps; hosiery; neckties; pantyhose; sandals; scarves; shoes and shoelaces; slippers; sneakers; socks and stockings; steel-toed shoes; and underwear

Contents means Household goods for which You are legally responsible or belonging to residents, including fixtures and fittings belonging to You (or for which You are responsible) not being landlord’s Fixtures and Fittings and interior decorations. This does not include: (a) Caravans, boats, motor vehicles, trailers, vessels, aircraft and their respective accessories while attached (b) Living creatures (c) Money and stamps belonging to resident Domestic Helpers (d) Securities, certificates or Documents (e) Property used or held for business professional purposes (f) Property more specifically insured by this or another policy.

Credit Cards means credit, debit, bankers and cash dispenser cards all held for social, domestic or charitable purposes.

Documents means Passport, Driving License, Work Permit, Residence Permit, Base Pass and Emirates ID Card.

Excess or Deductible means the first amount You must pay towards any claim made under the policy. In the event of a claim being made under more than one section of the policy for the same incident, You are only responsible for one deductible (whichever is higher).

Fees means Architects, surveyors and other professional fees which You have to pay in connection with repairing or reinstating the buildings. This does not include costs which You have to pay to prepare a claim or those You incur without our permission.

Fixtures and Fittings mean built-in furniture and kitchen units, fixed glass and sanitary ware, fixed pipes, ducts, tanks, wires, cables, switches, fires, central heating equipment, boilers, storage heaters and light fittings.

Geographical Limits means within UAE and any other area as stated in Your Policy schedule excluding USA and Canada.

Heave means upward or lateral movement of the site on which Your buildings stand caused by swelling of the ground.

Home means the private dwellings, its garages and Outbuildings all located at the address shown in the schedule and used solely for domestic purposes.

Household means the person(s) named in the Schedule and members of the family permanently residing with him/her, including resident Domestic Helpers employed by You and for whom You are legally responsible.

Insured/Insured Person/You/Your means the person(s) named in the Policy Schedule and members of the family permanently residing with him/her.

Jewellery means articles of personal adornment containing silver, gold, platinum or other precious metals, including watches and set or unset gemstones, but not Stamps, coins, cryptocurrencies (digital or physical) or medal collections, curios.

Money means Cash, bank and currency notes, cheques, money orders, postage stamps (not part of a collection), savings stamps and savings certificates, traveller’s cheques and gift tokens - used or held solely for private, social and domestic purposes. This does not include securities, certificates other than savings certificates and documents held for business or professional purposes.

Mould means any type or form of fungus, including but not limited to all forms of mould or mildew, and any mycotoxins, spores, scents, vapours, gas or substance, including any by-products, produced or released by mould.

Musical Instruments means a device (such as a violin, piano, or flute) used to make music.

Occurrence means:

  1. An Accident, Incident or Event, including continuous or repeated exposure to the same general harmful conditions, which Occurs during the policy period and results in personal injury or property damage; or
  2. An offence, including a series of related offences, committed during the policy period that result in personal injury or property damage.

Outbuildings means sheds, greenhouses, summerhouses, and other buildings (but not caravans, mobile homes or motor homes) which are not connected to the main building of the home. However, they are within the boundary of the home and are used for domestic purposes.

Perils means Fire, Lightning, Explosion, Earthquake, Smoke, Storm, Flood, Riot, Strike, Civil Commotion, Malicious Acts, Vandalism, Violent Theft, Attempted Violent Theft from Your Home, Subsidence or Heave of The Site on Which Your Buildings Stand or Land Belonging to Your Buildings, Landslip or Impact.

Period of Insurance/Policy Period means the period of time the insurance is provided for under this policy, as set out in Your schedule. This Policy’s coverage will commence on the policy effective date as detailed in the Policy Schedule and will run until the policy is cancelled or the policy expires on the policy expiration date shown in the Policy Schedule. The maximum period for any policy period is restricted to 1 year.

Permanent Total Disablement means a disability in which a Person is forever prevented from working because of Injury.

Personal Belongings means Jewellery, Sports Equipment, Portable Electronic Devices (PED), Musical Instruments, Money, Documents, Clothing, and other items that are designed to be worn or carried on or about the person which belong to You or Your family, or are Your family’s responsibility under contract.

Portable Electronic Devices (PED) means Cellular Communication Devices such as Mobile/Smart phones and pagers. Computing Devices such as laptop, notebook, tablet, hand-held, iPad, eBook and PDAs. Handheld Consoles such as games and toys. Media Players & Audio Recorders such as Mp3/Mp4 players, DVD/CD players, Audio Recorders, Audio Headsets and iPods. Photographic & Video Equipment such as camera and camcorders. Personal Timing Equipment such as smart watches. Portable Electronic Devices exclude Personal Medical Devices & Instruments such as hearing aids, heart pacemakers, neuro stimulators and other implanted medical devices, Medical Portable Electronic Device (M-PED) such as POCs, ventilators, respirators, nebulisers or CPAP machines.

Policy Effective Date means the date at which the Policy incepts as defined in the Policy Schedule.

Policy Schedule means the enclosed policy schedule that details the various insurances provided by this policy. The policy schedule contains the Insured Person’s details. The policy schedule includes the items chosen by the Insured Person with the respective Sum Insured against these items.

Removal of Debris means the amount payable to the Insurer for removing debris, demolishing, propping or shoring up parts of the buildings which have been damaged by Insured Perils. The amount payable is subjected to Policy Terms and Conditions.

Single Article Limit: Contents and Personal Belongings each have a single article limit. At the time of claim We will pay up to a maximum amount of the single article limit on any one item claimed for. The limits, unless another amount is shown in the Schedule, are as follows:

  • For Contents: AED 40,000.
  • For Personal Belongings: AED 10,000.

Sports Equipment means items of tangible personal property designed and sold for use in a sport or sporting activity, excluding apparel and footwear except that which is suitable only for use in a sport or sporting activity, and excluding board games, electronic games and similar devices, aircraft and powered vehicles, and replacement parts and accessories for any excluded item

Stolen means having been stolen by a third party without Your assistance, consent or co-operation.

Subsidence means downward movement of the site on which Your buildings stand, resulting from any Cause other than the bedding down of new structures or the settlement of newly made-up ground.

Sum Insured means the amount shown in the schedule representing the maximum amount payable for any number of claims arising out of one Occurrence or total number of Occurrences during the period of insurance.

Violent Theft means the act of stealing by use of force or threat of force or violent/forcible breaking into or exit from Your Home. Unexplained loss, Misplacement of an item, or Mysterious Disappearance are not considered as Violent Theft for the purpose of this Policy.

Unfurnished means a Home not containing enough furniture and furnishings for normal living purposes.

Unoccupied means not lived in or substantially empty of furnishings and contents for more than 30 days.

Valuables means pictures or other works of art, rugs or carpets, stamps or coins or medal collections but not jewellery.

Watercraft means a boat or craft designed for use on or over water.

We/Us/Company/Insurer/Our means Emirates Insurance Company.


COVER 1: BUILDINGS & CONTENTS
WHAT WE COVER

If the Property Insured or any part thereof shall be accidentally physically lost, destroyed or damaged the Insurers will pay to the Insured the value of the property at the time of the happening of its loss or destruction or the amount of such damage or at their option reinstate or replace such property or any part thereof.

PROVIDED THAT

(1) the liability of the Insurers shall, in no case, exceed in respect of each item, the sum expressed in the said Schedule to be insured thereon or in the whole the total sum insured hereby or such other sum or sums as may be substituted therefore by memorandum hereon or attached hereto signed by or on behalf of the Insurers.

(2) the liability of the Insurers individually in respect of such loss, destruction or damage shall be limited to the proportion set against its name

EXCEPTIONS

1. The Insurers will not indemnify the Insured in respect of

  1. electrical or mechanical breakdown or derangement of plant machinery or equipment.
  2. deterioration of property due to change in temperature or humidity or failure or inadequate operation of an air-conditioning cooling or heating system.
  3. subsidence, ground heave, landslip, erosion, settling or cracking.

UNLESS EITHER

(i) caused by fire, lightning or explosion

(For the purpose of this exception "explosion" shall not mean the bursting or disruption of turbines, compressors, transformers, rectifiers, switchgear, engine cylinders, hydraulic cylinders, fly-wheels or other moving parts subject to centrifugal force or boilers, economisers or other vessels machinery or apparatus in which pressure is used)

Aircraft or other aerial devices or articles dropped therefrom, impact by vehicles, watercraft, locomotives or rolling stock, earthquake, riot or malicious acts (other than any act excluded by reason of exception 6 (b) herein Strikes, locked-out workers or persons taking part in labour disturbances, storm, tempest flood

OR

(ii) resulting in the occurrence of any of the events in (i) above then the Insurers will only indemnify the Insured under the Terms of the Policy in respect of the resultant loss, destruction or damage.

2. Loss, destruction or damage to:

  1. property in course of manufacture if such loss, destruction or damage is sustained while the property is being actually worked on and directly resulting from such work.
  2. property in the course of construction or erection.
  3. boilers, economisers, turbines or other vessels, machinery or apparatus in which pressure is used or their contents resulting from their explosion or rupture.
  4. plant machinery or equipment during installation, dismantling or the stripping down and assembly in respect of any re-sitting operations.
  5. electrical equipment or wiring caused by electrical current (other than lightning).
  6. money, cheques, bullion, negotiable instruments and securities of all kinds
  7. animals, growing crops, or standing timber.
  8. dams, reservoirs, piers, wharves, jetties, bridges or tunnels.
  9. any vehicle licensed for road use railway locomotives and rolling stock watercraft or aircraft or property contained in water craft or aircraft.
  10. property whilst in transit other than at any premises described in the Schedule.
  11. documents, manuscripts, business books or computer systems records for the value to the insured of the information contained therein,
  12. property/contents whilst the principal address was left vacant or unoccupied for more than 30 days.
  13. building & contents whilst home is lent, let, sub-let in whole or in part.

HOWEVER, the Insurers will indemnify the Insured in respect of loss destruction or damage to:

(a) documents, manuscripts and business books but only for the value of the materials as stationery together with the cost of clerical labour expended in writing up.

(b) computer systems records but only for the value of the materials together with the costs and expenses necessarily incurred by the Insured in reproducing such records (excluding any cost or expense in connection with the production of information to be recorded therein).

3.

  1. consequential loss of any kind or description whatsoever.
  2. loss resulting from dishonesty, fraudulent action, trick device or other false pretence.
  3. loss resulting from theft unless accompanied by violence to persons or threat of violence or forcible and violent entry to or exit from the premises.
  4. loss resulting from unexplained or mysterious disappearance or shortage revealed at any periodic inventory or shortage in the supply or delivery of materials or loss or shortage due to clerical or accounting error
  5. the cost of replacing or rectifying defective materials, workmanship, design or defect or omission in design plant or specification.
  6. contamination, pollution, wear and tear, corrosion, vermin, fungus not gradual, deterioration, deformation or distortion, shrinkage, evaporation, loss of weight, change of flavour, colour, texture or finish or action of light.
  7. the cost of normal upkeep or normal making good.
  8. the freezing or solidification of molten material.

4. Loss destruction or damage by storm, tempest water, hail, frost or snow to property

  1. in the open (other than building structures and plant designed to exist and operate in the open).
  2. contained in open-sided buildings.

UNLESS so described and specifically insured as a separate item in the Schedule.

5. The amount stated in the Schedule as the deductible in respect of each and every occurrence or a series of occurrences consequent on or attributable to one source or original cause giving rise to loss, destruction or damage the subject of indemnity under this Policy.

6. Any loss destruction or damage directly or indirectly occasioned by or through or in consequence of:

  1. war, invasion, act of foreign enemy hostilities or warlike operations (whether war be declared or not), civil war.
  2. mutiny, civil commotion assuming the proportions of or amounting to a popular rising military rising, insurrection, rebellion, revolution, military or usurped power or any act of any person acting on behalf of or in connection with any organisation with activities directed towards the overthrow by force of the Government de jure or de facto or to the influencing of it by terrorism or violence.
    1. permanent or temporary dispossession resulting from confiscation, nationalisation, commandeering or requisition by any lawfully constituted authority.
    2. permanent or temporary dispossession of any building resulting from the unlawful occupation of such building by any person.

Provided that the Insurers are not relieved of any liability to the Insured in respect of physical damage to the property insured occurring before dispossession or during temporary dispossession which is otherwise insured by this Policy.

  1. the destruction of property by order of any public authority.

In any action suit or other proceeding where the Insurers allege that by reason of the provisions of exceptions 6 (a) and 6 (b) above any loss, destruction or damage is not covered by this insurance the burden of proving that such loss destruction or damage is covered shall be upon the Insured.

7. Any loss destruction or damage directly or indirectly caused by or arising from or in consequence of or contributed to by:

  1. nuclear weapons material.
  2. ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel solely for the purpose of this exception 7(b) combustion shall include any self-sustaining process of nuclear fission.

8. Loss or damage caused by pressure waves from aircraft or other aerial devices travelling at sonic or supersonic speed.

9. Losses arising directly or indirectly from:

  1. the loss of, alteration of, or damage to
    Or
  2. a reduction in the functionality, availability or operation of
    a computer system, hardware, programme, software, data information repository, microchip, integrated circuit or similar device in computer equipment that results from the malicious or negligent transfer and any subsequent onward transfer (electronic or otherwise) of a computer programme that contains any malicious and/or damaging code, including but not limited to computer virus, worm, logic bomb, Keylogging, or Trojan horse and which can be identified as the cause of loss.

10. Any loss of or damage to crops, trees and plants.

11. The Insurers will indemnify the Insured in respect of damage caused by the leakage of water from water tanks, pipes, fixed apparatus or fixed heating installation and damage caused by the leakage of heating fuel from a fixed heating installation.

But not:

  1. Loss or damage whilst the home has been left unoccupied for more than 30 days.
  2. Loss or damage to the component or appliance from which the water or oil leaks.
  3. Cost of locating and rectifying the source of leakage of water or oil.
ADDITIONAL COVERS FOR BUILDINGS AND CONTENTS
1. Loss of Rent and Alternative Accommodation for building owner

If Your home is made uninhabitable by any of the Causes insured, we will pay for:

(i) The rent You should have received but have lost whilst Your home is unfit to live (if non-occupying landlord). This section is only payable if You have a tenant currently renting Your property, and the payment made will be paid based on the tenant’s existing rental contract.

or

(ii) If you are the owner-occupier, reasonable additional cost of comparable alternative accommodation until Your home is fit to live in again.

(a) Excluding costs which You incur without our written permission.

We will pay up to a maximum of 12 months’ rent subject to a limit of 20% of the building Sum Insured up to a maximum limit of AED 250,000 or the reinstatement of the building making it fit to live, whichever comes first.

In the event that You have both buildings and contents covered, only one section can be claimed off.

2. Rent and Alternative Accommodation for tenant

If Your home is made uninhabitable by any of the Causes insured, We will pay the rent which You still have to pay for parts of Your rental home which are unfit to live in or the reasonable additional costs of comparable alternative accommodation until Your home is fit to live in again. We will pay up to a maximum of 12 months’ rent subject to a limit of 20% of the contents sum insured, up to a maximum limit of AED 250,000.

This cover is only payable if You reside in the premise You are insuring. In the event that You have both buildings and contents covered, only one section can be claimed off.

3. Occupiers Liability To The Public

The Company will indemnify the Insured against all sums for which the Insured may be legally liable for up to 5,000,000 AED

The Insurance Policy includes any Liability that the assured shall become legally liable to pay in respect of claims made by third parties at the insured premises in respect of:

  1. accidental bodily injury (whether fatal or not)
  2. accidental damage of property

Occurring in or about the Buildings during the Period of Insurance.

Provided that the Company shall not be liable in respect of:

  1. bodily injury to any person being a member of the Insured’s family or household, or at the time of sustaining such injury engaged in and upon the service of the Insured.
  2. damage to property belonging to or in the charge of or under the control of, the Insured or a member of the Insured’s family or household or of a person in the service of the Insured.
  3. bodily injury or damage arising out of or incidental to:
    1. The Insured’s profession or business
    2. The use of lifts, elevators or vehicles
  4. Any liability which attaches by virtue of an agreement but which would not have attached in the absence of such agreement.

In addition, in respect of a claim to which the indemnity expressed in this Section applies the Company will pay

  1. All costs and expenses recovered by any claimant from the Insured and
  2. All costs and expenses incurred with the written consent of the Company
4. Tenant’s Liability towards Landlord

If you are a tenant of your home and not the owner, insurance is provided for up to a limit of up to AED 1,000,000 which you are liable to pay under the terms of your tenancy agreement for:

a) Buildings

Damage to the buildings of your home by any of the causes listed under COVER 1: BUILDINGS & CONTENTSS

b) Interior Decorations and Fixtures

Damage to the internal decorations or landlords’ fixtures and fittings of your home from any of the causes listed under COVER 1: BUILDINGS & CONTENTS

c) Pipes and Cables

Accidental damage to those underground services supplying the buildings

Excluding

  1. Injury, death or disease of any member of your household.
  2. Loss of, or damage, to property owned or in custody or control of you or any member of your household.
  3. An agreement unless the liability would have existed without the agreement.
  4. The employment, business or profession of you or any member of your household.
  5. Any liability arising directly or indirectly from any mechanically or electrically propelled vehicles (other than gardening equipment), boats, aircraft, model aircraft, drones, unmanned aerial vehicles, Segway, caravans, personal transportation equipment for children and adults, equipment using robotics technology, any electronic devices designed to be operated solely by power from its electrical system or designed for recreational use including their accessories owned by or in custody or control of you or any member of your household or any other persons.
  6. Any liability arising out of the ownership of land or buildings by you or any member of your household.
  7. Any liability arising out of the occupation of land or building by any member of your household other than your home.
  8. Any liability arising out of any deliberate act.
  9. A contract of service and arising out of the work they are employed to do.
  10. Any liability arising out of Transmission of any communicable disease or virus suffered by any member of your household or any domestic servant.
  11. Any liability arising from hunting racing.
  12. Any liability which is insured by or would be insured by any other policy if this did not exist.
  13. Any liability arising directly or indirectly from or in consequence of or any way involving asbestos.
  14. Any loss or damage if the property was left vacant or unoccupied for 30 days
5. Key and Locks

If keys to the locks of external doors of Your Home, alarm systems or domestic safes fitted in Your Home are stolen We will pay the cost of replacing locks or lock mechanisms subject to a limit of 1% of the content Sum Insured up to 2,000 AED.

  1. Excluding loss or violent theft of keys not reported to the police.
  2. Excluding loss or damage caused while Your home is lent, let, sublet or shared with anyone other than Your family.
  3. Excluding loss or damage caused by mechanical, electrical or electronic fault, failure or Breakdown.
6. Temporary Removal

Loss of or damage to the contents by any cause insured by Cover 1 while temporarily removed for cleaning, renovation, repair or other similar purposes, from your home into a bank safe deposit, occupied private dwelling or any building where any members of your household are living or carrying on their business within the UAE subject to a maximum of 20% of the contents sum insured.

  1. Excluding loss or damage in furniture depository or storage.
  2. Excluding loss or damage caused by storm or flood to property not in a building.
  3. Excluding loss or damage by theft unless force is used to gain entry into or exit from a building.
  4. Excluding loss of money and personal possessions.
7. Visitor’s Personal Effects

If an insured Peril Causes loss or damage to Your visitor’s belongings while in Your home, we will pay a maximum amount of AED 2,500 during any one policy period.

We will not pay for any claim arising from any of the following:

  1. Excluding loss of money, credit cards, jewellery, valuables and documents
  2. Loss or damage specifically excluded elsewhere in the policy wording
8. Furniture in Transit

Accidental loss of or damage to the contents during their transit by land by professional removal contractors from your existing home directly to your new home subject to both homes being in the UAE.

  1. Excluding the first AED 250 of each claim in addition to the excess shown in the schedule.
  2. Excluding damage caused solely by wear, tear or depreciation, vermin, insect, domestic pets, mildew or fungus.
  3. Excluding loss or damage to property in furniture depository or storage.
  4. Excluding loss of or damage to visitors’ personal possessions.
  5. Excluding loss of or damage to china, glass, earthenware and other items of a brittle nature, unless they have been packed by professional packers.
  6. Excluding money personal possessions coins jewellery furs articles of gold or platinum precious stones securities deeds or documents of any kind business books manuscripts and stamps
  7. Excluding claims submitted during the first ninety (90) days of Policy issuance.
9. Contents in the Open

Loss of or damage to the contents by any cause insured by Cover 1 occurring in the open within the boundaries of the land belonging to the home – up to AED 2500.

  1. Excluding loss or damage caused by storm or flood.
  2. Excluding loss or damage occurring after the home has been left unoccupied for 30 consecutive days.
  3. Excluding loss or damage to pedal cycles
10. Deep Freezer Contents

Loss of or damage to food in a domestic deep freezer caused by:

  1. A rise or fall in temperature.
  2. Contamination from refrigerant or refrigerant fumes

up to 1% of your contents sum insured value, including loss or damage to food which has been removed from the deep freezer following an incident insured by this policy.

  1. Excluding Loss or damage due to the deliberate act of the power supply authority or the withholding or restricting of power by the authority.
  2. Excluding Loss or damage resulting from willful neglect by you or your household.
  3. Excluding Loss or damage to food in your deep freezer if the compressor unit is more than 10 years old.

COVER 2: PERSONAL BELONGINGS

Personal Belongings means Jewellery, Sports Equipment, Portable Electronic Devices (PED), Musical Instruments, Money, Documents, Clothing, and other items that are designed to be worn or carried on or about the person which belong to You or Your family, or are Your family’s responsibility under contract.

WHAT WE COVER

This cover is applicable only when shown in Your schedule.

We will pay for your Personal Belongings (as mentioned in the Policy Schedule) in the event of Violent Theft, or damage by Accidental means up to the Sum Insured shown in the Schedule against each Personal Belonging, whilst within the Geographical Limit and whilst temporarily elsewhere in the world (excluding USA and Canada) for not more than 90 days in any Period of Insurance

EXCLUSIONS applicable to COVER 2: PERSONAL BELONGINGS

We will not pay for:

  1. Damage due to wear and tear.
  2. Damage caused by vermin, insects, domestic pets, mildew or fungus.
  3. Damage solely caused by mechanical or electrical breakdown.
  4. Loss or damage caused by nationalisation or confiscation by any authority.
  5. Loss by deception unless it is only entry into Your home that is gained by deception.
  6. Items misplaced or lost at home or anywhere within the geographical limits including unexplained losses or mysterious disappearance.
  7. Loss or damage resulting from violent theft that was not reported to the Police.
  8. Loss or damage arising from any deliberate act by You or Your household or any other persons.
  9. Loss or damage caused while Your home is unoccupied after 30 consecutive days.
  10. Loss or damage caused while Your home is lent, let, sub-let or shared with anyone other than Your family, unless there is evidence of forcible and violent entry to or exit from Your home.
  11. Loss, theft or damage to goods or property You or any member of Your family own or use at any time for trade, professional or business purposes.
  12. Loss or damage caused by scratching, denting or chipping.
  13. Loss or damage caused by any process of dyeing, washing, cleaning, restoring, reproofing, adjusting, maintaining or repairing.
  14. Loss, theft or damage to reeds, strings or skins of musical instruments.
  15. Loss or damage to musical instruments while in use.
  16. Excluding valuables left in the open or an unattended motor vehicle, unless left in a locked boot, locked and covered luggage area or locked glove compartment of a motor vehicle, and following physical evidence of forcible entry.
  17. Excluding valuables in transit on a journey and not in Your custody or control.
  18. Mechanically or electrically propelled vehicles (other than gardening equipment), boats, aircraft, model aircraft, drones, unmanned aerial vehicles, Segway, caravans, personal transportation equipment for children and adults, equipment using robotics technology, any electronic devices designed to be operated solely by power from its electrical system or designed for recreational use including their accessories owned by or in custody or control of You or any member of Your household or any other persons.
  19. Damage to Sports Equipment while in play.
  20. Skis (including sticks and bindings), watercraft, sub-aqua equipment, camping equipment, and riding track.
  21. Bikes/Pedal Cycles.
  22. Contact and corneal lenses and hearing aids.
  23. Consequential Loss.
  24. Loss or damage due to business or professional use in respect of musical instruments, photographic and sporting equipment and accessories.
  25. Money, credit cards, securities, Documents.
  26. Loss or damage to property dispatched by sea or air under a bill of lading, airway bill or similar document.
  27. Livestock and pets.
  28. Personal Belongings exceeding the single article limit unless it is mentioned in Your policy schedule.
1. Jewellery

This cover is applicable only when shown in Your schedule.

We will pay for your Jewellery, in the event of Violent Theft, or damage by Accidental means up to the Sum Insured shown in the Schedule whilst within the Geographical Limit and whilst temporarily elsewhere in the world (excluding USA and Canada) for not more than 90 days in any Period of Insurance.

  1. Excluding Jewellery exceeding the single article limit unless it is mentioned in Your policy schedule.
  2. Excluding losses where your Jewellery was not kept in a safe or locked box while not in use
2. Portable Electronic Devices

This cover is applicable only when shown in Your schedule.

We will pay for your Portable Electronic Devices, in the event of Violent Theft, or damage by Accidental means up to the Sum Insured shown in the Schedule whilst within the Geographical Limit and whilst temporarily elsewhere in the world (excluding USA and Canada) for not more than 90 days in any Period of Insurance.

  1. Excluding Portable Electronic Devices exceeding the single article limit unless it is mentioned in Your policy schedule.
3. Clothing

This cover is applicable only when shown in Your schedule.

We will pay for your Clothing, in the event of Violent Theft, or damage by Accidental means up to the Sum Insured shown in the Schedule whilst within the Geographical Limit and whilst temporarily elsewhere in the world (excluding USA and Canada) for not more than 90 days in any Period of Insurance.

  1. Excluding specialised sports clothing.
4. Documents

This cover is applicable only when mentioned in your policy schedule.

We will reimburse the cost of issuing a duplicate document which is/are accidentally damaged while within the geographical limit and while temporarily elsewhere in the world (excluding USA and Canada) for not more than 90 days in any period of insurance.

The maximum amount which can be indemnified is AED 1000 per document subject to a maximum of AED 3000 for all documents during the period of insurance.

Provided always that:

(i) This Cover applies only to You and Household excluding Domestic Helpers.

(ii) Reimbursement will be for the cost of making a similar duplicate, advertisement fees if required, fines and penalties if imposed and other out of pocket expenses for which bills must be produced.

  1. Excluding the first AED 100 of each and every loss.
  2. Excluding renewal or extension costs of the lost or damaged document which you would have had to bear if there had been no loss.
5. Sports Equipment

This cover only applies when shown in your Schedule.

We will provide cover for your Sports Equipment in the event of Violent Theft or damage by Accidental means whilst within the Geographical Limit and whilst temporarily elsewhere in the world (excluding USA and Canada) for not more than 90 days in any Period of Insurance.

  1. Excluding equipment for mountaineering, potholing, skiing, windsurfing and underwater sports, motor vehicles, trailers, caravans, boats, vessels, aircraft and their respective accessories.
  2. Excluding living creatures.
  3. Excluding Clothing other than specified sports clothing.
  4. Excluding Bikes/Pedal Cycles.
  5. Excluding Loss or damage whilst in use.
  6. Excluding Loss or damage to golf balls unless contained in the golf bag at the time of the loss or damage.
6. Bikes/Pedal Cycles

This cover only applies when shown in your Schedule.

We will provide cover for your Bikes/Pedal Cycles in the event of Violent Theft or damage by Accidental means whilst within the Geographical Limit and whilst temporarily elsewhere in the world (excluding USA and Canada) for not more than 90 days in any Period of Insurance.

  1. Excluding theft of the Bikes/Pedal Cycles or parts of the Bike/Pedal Cycles unless the bike is in a locked building or has been immobilised by a security device.
  2. Excluding loss or damage while the Bikes/Pedal Cycles is being used in any kind of competitive event or race.
  3. Excluding loss or damage to tyres or accessories unless the Bikes/Pedal Cycles is lost or damaged at the same time.
7. Musical Instruments

This cover only applies when shown in your Schedule.

We will provide cover for your Musical Instruments in the event of Violent Theft or damage by Accidental means whilst within the Geographical Limit and whilst temporarily elsewhere in the world (excluding USA and Canada) for not more than 90 days in any Period of Insurance.

  1. Excluding Loss, theft or damage to reeds, strings or skins of musical instruments.
  2. Excluding Loss or damage to musical instruments while in use.
8. Money and Credit Card

This cover only applies when shown in your Schedule.

We will provide cover for your Personal Money and Credit Cards in the event of Violent Theft or damage by Accidental means whilst within the Geographical Limit and whilst temporarily elsewhere in the world for not more than 90 days in any Period of Insurance.

Credit Cards are insured only against any loss as a result of misuse by any unauthorised person following the Violent Theft of any such card before the card company has received notification of the loss and provided that you comply with the terms under which the card was issued. The maximum we will pay during the Period of Insurance for this Cover is 5% of your personal belonging limit unless another amount is shown in the Schedule.

  1. Excluding shortages due to error or omission.
  2. Excluding losses not reported to the police or you did not obtain a police report on the occurrence of the theft incident, identifying the items lost or damaged.
  3. Excluding loss of credit cards not reported to the card issuing company within 24 hours of discovery.

POLICY CONDITIONS
1. DEFINITION

This Policy and the Schedule shall be read together as one contract and any word or expression to which a specific meaning has been attached in any part of this Policy or of the Schedule shall bear such meaning wherever it may appear.

2. MISDESCRIPTION

If there be any material misdescription of any of the Property insured or of any building or place in which such property is contained or any misrepresentation as to any fact material to be known for estimating the risk or any omission to state such fact the Insurers shall not be liable under this Policy so far as it relates to property affected by any such misdescription, misrepresentation or omission.

3. ALTERATION

Under any of the following circumstances the insurance under this Policy ceases to attach as regards the property affected unless the Insured before the occurrence of any loss or damage obtains the sanction of the Insurers signified by endorsement upon the Policy by or on behalf of the Insurers

  1. if the trade or manufacture carried on be altered or if the nature of the occupation of or other circumstances affecting the building insured or containing the insured property be changed in such a way as to increase the risk of loss or damage.
  2. if the building insured or containing insured property becomes unoccupied and so remains for a period of more than 30 days.
  3. if the property insured be removed to any building or place other than that in which it is herein stated to be insured.
  4. if the interest in the property insured passes from the insured otherwise than by will or operation of law.
4. CANCELLATION

This Insurance may be terminated at any time at the request of the Insured in which case the Insurers will retain the customary short period rate for the time the Policy has been in force.

This Insurance may also at any time be terminated at the option of the Insurers on notice to that effect being given to the Insured in which case the Insurers shall be liable to repay on demand a rateable proportion of the premium for the unexpired term from the date of the cancellation.

There will be an administration fee of AED 50 chargeable for all premium refunds.

5. SAFEGUARDS AND MAINTENANCE

The Insured shall at all times and as far as is reasonably practicable take steps to safeguard the property insured and maintain it in a proper state of repair. The Insured shall also take steps to enforce the observance of all statutory provisions, manufacturer's recommendations and other regulations relating to the safety use and inspection of the property insured.

6. CLAIMS

On the happening of any loss, destruction or damage the Insured shall forthwith give notice thereof in writing to the insurers and shall within 15 days after such loss, destruction or damage, or such further time as the Insurers may in writing allow, at his own expense deliver to the Insurers a claim in writing containing as particular an account as may be reasonably practicable of the several articles or portions of property lost, destroyed or damaged and of the amount of such loss, destruction or damage thereto respectively having regard to their value at the time of the loss, destruction or damage together with details of any other insurances on any property hereby insured

The Insured shall also give to the Insurers all such proofs and information with respect to the claim as may be reasonably required together with (if demanded) a statutory declaration of the truth of the claim and of any matters connected therewith. No claim under this Policy shall be payable unless the terms of this Condition have been complied with.

In the case of property lost or stolen or if wilful or malicious damage is suspected the Insured shall immediately notify the police and render all reasonable assistance in causing the discovery and punishment of any guilty person and in tracing and recovering lost or stolen property.

7. INSURERS RIGHTS AFTER A LOSS

On the happening of any loss destruction or damage to any of the property insured the Insurers may

  1. enter and take and keep possession of the building or premises where the loss or damage happened.
  2. take possession of or require to be delivered to them any property of the Insured in the building or on the premises at the time of the loss or damage.
  3. keep possession of any such property and examine sort arrange remove or otherwise deal with the same.
  4. sell any such property or dispose of the same for account of whom it may concern.

The powers conferred by this Condition shall be exercisable by the Insurers at any time until notice in writing is given by the Insured that they make no claim under this Policy, or if any claim is made, until such claim is finally determined or withdrawn, and the Insurers shall not by any act done in the exercise or purported exercise of their powers hereunder, incur any liability to the insured or diminish their right to reply upon any of the conditions of this Policy in answer to any claim.

If the Insured or any person on their behalf shall not comply with the requirements of the Insurers or shall hinder or obstruct the Insurers in the exercise of their powers hereunder all benefit under this Policy shall be forfeited.

The Insured shall not in any case be entitled to abandon any property to the Insurers whether taken possession of by the Insurers or not.

8. FORFEITURE

IIf any claims upon this Policy be in any respect fraudulent or if any fraudulent means or devices are used by the Insured or any one acting on his behalf to obtain any benefit under this Policy or if the loss, destruction or damage be occasioned by the wilful act or with the connivance of the Insured all benefit under this Policy shall be forfeited.

9. TIME LIMITATION

If a claim is made and rejected and an action or suit be not commenced within three months after such rejection or (in case of an arbitration taking place in pursuance of the condition 14 of this Policy) within three months after the Arbitrator shall have made his award all benefit under this Policy shall be forfeited.

10. REINSTATEMENT

If the Insurers elect or become bound to reinstate or replace any property the Insured shall at his own expense produce and give to the Insurers all such plans, documents, books and information as the Insurers may reasonably require. The Insurers shall not be bound to reinstate exactly or completely but only as circumstances permit and in reasonably sufficient manner and shall not in any case be bound to expend in respect of any one of the items insured more than the sum insured thereon.

11. SUBROGATION

The Insured shall at the expense of the Insurers, do and concur in doing and permit to be done all such acts and things as may be necessary or reasonably required by the Insurers for the purpose of enforcing any rights and remedies or of obtaining relief or indemnity from other parties to which the Insurers shall be or would become entitled or subrogated upon its paying for or making good any loss, destruction or damage under this policy, whether such acts and things shall be or become necessary or required before or after their indemnification by the Insurers.

12. MARINE

This Insurance does not cover any loss or damage to property which, at the time of the happening of such loss or damage, is insured by or would, but for the existence of this Policy, be insured by any Marine Policy or policies except in respect of any excess beyond the amount which would have been payable under the Marine Policy or policies had this insurance not been effected.

13. CONTRIBUTION

If at the time of any loss, destruction or damage happening to any property insured there be any other subsisting insurance or insurances whether impacted by the Insured or by any other person or persons covering the same property the Insurers shall not be liable to pay or contribute more than their rateable proportion of such loss, destruction or damage.

14. AVERAGE

If the property Insured shall at the time of any loss, destruction or damage be collectively of greater value than the sum insured thereon then the Insured shall be considered as being his own Insurer for the difference and shall bear a rateable proportion of the loss accordingly. Every item if more than one of the Policy shall be separately subject to this condition.

15. ARBITRATION

If any difference shall arise as to the amount to be paid under this Policy (liability being otherwise admitted) each difference shall be referred to an Arbitrator to be appointed by the parties in accordance with the Statutory provision in that behalf for the time being in force. Where any difference is by this condition to be referred to arbitration the making of an award shall be a condition precedent to any right of action against the Insurers.

16. OBSERVANCE OF CONDITIONS

The due observance and fulfilment of the terms conditions and endorsements of this Policy by the Insured in so far as they relate to anything to be done or complied with by them shall be conditions precedent to any liability of the Insurers to make payment under this Policy.

ADDITIONAL CLAUSES FOR BUILDINGS & CONTENTS
1. Professional fees clause

The sum insured includes, for the amount stated in the Schedule, costs and expenses necessarily incurred by the Insured in respect of:

  • Architects` Fees
  • Auditors` Fees
  • Engineers` Fees
  • Surveyors` and Quantity Surveyors` Fees
  • Accountants` Fees

and any other Professional Fees necessarily incurred in restoring the portion or portions of the property insured by this Policy destroyed or damaged by Fire or by any other peril hereby insured against.

2. Alterations and repair clause

Provided accepting the payment of the agreed additional premium, except as otherwise provided, with respect to specific perils permission is hereby granted (a) to make alterations, renovations, improvements and repairs to any building covered hereunder, and to construct additions which attach to and communicate with such building, and the insurance, if any hereunder, with such building, is hereby made to cover such alterations, improvements, repairs, attached and communicating additions, also building materials and supplies thereof, while contained therein or on the premises immediately adjacent thereto and (b) to make such use of the premises is usual and incidental to the occupancy as described in this Policy.

Provided that nothing in this extension shall preclude the Insurers from exercising their right of recourse against the contractors.

3. Workmen maintenance clause

Workmen are allowed on the within mentioned premises for the purpose of making structural and other alterations from time to time without prejudice to this insurance.

4. Capital additions clause

The Insurance hereby extends to cover additions or alterations to property but excluding any appreciation in value of existing property in excess of the sums Insured.

The Insured undertakes to advise the Insurer at the end of each policy period of the amount of such additions and alterations and of any deletions of property insured. At the expiry of each period of insurance the premium shall be adjusted on the basis of these declarations, the Insured paying or the Insurer returning the appropriate premium as the case may be.

No return of premium shall, however, be made in respect of the reduction resulting from destruction or damage which is the subject of a claim under this Section. The insured is required to give notice to the insurers immediately of any capital addition in excess of 10% of the capital sum insured and cover will attach only on receipt of the insurer's specific confirmation. The provisions hereof shall be fully reinstated at each renewal.

5. Cost escalation (increase value clause)

Notwithstanding the limits/sum insured stated in the policy, the indemnity granted by this Policy extends to include indemnity up to an additional limit of 10% of the sum stated in the schedule, should the cost of repair or replacement arising out of a recoverable loss be increased due to an increase in cost of material, labour or any other reasonable factor, subject to an additional premium in respect of the amount thus increased.

All other terms, conditions and exclusions will remain unaltered.

6. Public authorities’ clause

The Insurance by this policy extends to include such additional cost of reinstatement of the destroyed or damaged property hereby insured as may be incurred solely by reason of the necessity to comply with the building or other regulations under or framed in pursuance of any Act of Government or with By-Laws of any Municipal or Local Authority provided that:

  1. The amount recoverable under this extension shall not include:

    1. The cost incurred in complying with any of the aforesaid regulation or by - laws.

      1. In respect of destruction or damage occurring prior to the granting to this extension;
      2. In respect of destruction or damage not insured by the section;
      3. Under which notice has been served upon the Insured prior to the happening of the destruction or damage;
      4. In respect of undamaged property or undamaged portions of property, other than foundations (unless foundations are specifically excluded from the insurance by the Section) of that portion of the property destroyed or damaged.
    2. The additional cost that would have been required to remedy the property damaged or destroyed to a condition equal to its condition when new had the necessity to comply with any of the aforesaid Regulations or By - Laws not arisen.
    3. The amount of any rate, tax, duty, development or other charge or assessment arising out of capital appreciation which may be payable in respect of the property or by the owner thereof by reason of compliance with any of the aforesaid Regulations or By - Laws;
  2. The work of reinstatement must be commenced and carried out with reasonable dispatch and in any case must be completed within twelve months after the destruction or damage or within such further time as the Insurer may (during the said twelve months) in writing allow and may be carried cut wholly or partially upon another site (if the aforesaid regulations or By - Laws so necessitate) subject to the liability of the Insurer under this extension not being thereby increased.
  3. If the liability of the Insurer under any item of the Section apart from this extension shall be reduced by the application of any of the terms and conditions of the Policy then the liability of the Insurer under this extension (in respect of any such item) shall be reduced in like proportion.
  4. The total recoverable under any item of the Section shall not exceed 10% of the sum Insured.
  5. All the conditions of the section except in so far as they may be hereby expressly varied shall apply as if they had been incorporated herein.
7. Electrical clause

This Company expressly declared to be free from liability for loss of or damage to any electrical machine, apparatus, fixture or fitting (including electric fans, electrical household or domestic appliances, wireless sets and radios) or to any portion of the electrical installation, arising from or occasioned by overrunning, excessive pressure, short circuiting, arcing self-heating, or leakage of electricity from whatever cause (lighting included), provided that this exemption shall apply only to the particular electrical machine, apparatus, fixture, fitting or portion of the electrical.

8. Errors and omissions clause

Notwithstanding anything to the contrary contained in this Policy, it is hereby declared and agreed that No Inadvertent Error, Omissions or Failure in Furnishing Reports hereunder shall prejudice the Assured`s Right of Recovery but shall be corrected when discovered.

9. No control clause

This insurance shall not be prejudiced by any act of neglect of the owner of any building if the Assured is not the owner thereof, or by any act or neglect of any occupancy (other than the Assured) of any building, when such act or neglect of the owner or occupant is not within the control of the Assured, or by failure of the Assured to comply with any warranty or conditions contained in any form or endorsement attached to this policy with regard to any portion of the premises over which Assured has no control.

10. Non-invalidation clause

This insurance shall not be invalidated by any act or omission mis-description of occupancy or by any alteration where the risk of destruction or damage is increased, unknown to or beyond the control of an Insured, provided that as soon as the insured becomes aware of the situation, he gives notice to Insurers who may require an additional premium for the increased risk.

11. Works of Art Restriction

All items of Works of Art, including but not limited to paintings, sculptures, designer carpets, antiques, curios, hereditary possessions shall be restricted to Fire and defined perils including theft, unless specifically agreed otherwise in writing.

12. War and Terrorism Exclusion Clause

Notwithstanding any provision to the contrary within this Contract or any endorsement thereto it is agreed that this Contract excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any of the following regardless of any other cause or event contributing concurrently or in any other sequence to the loss:

  1. War, or state of war, whether declared or not, invasion, acts of foreign enemies, hostilities or warlike operations, and/or
  2. Civil war, rebellion, revolution, insurrection, mutiny, riot, strike, military or popular rising, and/or
  3. Civil commotion assuming the proportions of or amounting to a popular rising, and/or
  4. Martial law, state of siege, state of emergency or any event(s) or cause(s) which directly or indirectly lead(s) to the proclamation to establish, the establishment or maintenance of martial law, a state of siege and/or a change of government or head of state, and/or
  5. Any act intending to overthrow or influence the government, local authorities or part of them with force, by means of fear, with violence or the threat thereof, and/or
  6. Any act of terrorism, and/or
  7. Looting, pillage, felony, theft, burglary, malicious damage, vandalism or any comparable activity if they occur in parallel or in connection with any act referred to in point 1 to 6 of this endorsement.

This endorsement also excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to 1 to 7 above.

For the purpose of this endorsement an act of terrorism means an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public, or any section of the public, in fear.

If the insurers allege that by reason of this exclusion, any loss, damage, cost or expense is not covered by this insurance the burden of proving the contrary shall be upon the insured.

In the event any portion of this endorsement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

Notwithstanding the foregoing, it shall be further understood and agreed that as regards:

Strike, Riot, Civil Commotion contained within item 2 and/or 3 above, for the purposes of this Contract Strike, Riot, Civil Commotion shall be defined as being any act of Strike, Riot, Civil Commotion for political means only.

13. Nuclear/Chemical/Biological Terrorism Exclusion

It is agreed that, regardless of any contributory cause(s), this insurance does not cover any claim(s) in any way caused or contributed to by an act of terrorism involving the use or release or the threat thereof of any nuclear weapon or device or chemical or biological agent.

For the purpose of this exclusion an act of terrorism means an act, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), committed for political, religious, ideological or ethnic purposes or reasons including the intention to influence any government and/or to put the public, or any section of the public, in fear.

If the Underwriters allege that by reason of this exclusion any claim is not covered by this insurance the burden of proving the contrary shall be upon the Assured.

14. Nuclear Energy Risks Exclusion Clause

This agreement shall exclude Nuclear Energy Risks whether such risks are written directly and/or by way of insurance and/or via Pools and/or Associations.

Nuclear Energy Risks shall mean insurances in respect of:

  1. All Property, on the site of a nuclear power station. Nuclear Reactors, reactor buildings and plant and equipment therein on any site other than a nuclear power station
  2. All Property, on any site (including but not limited to the sites referred to in 1 above) used or having been used for:

    1. The generation of nuclear energy; or
    2. The Production, Use or Storage of Nuclear Material.
  3. Any other Property eligible for insurance by the relevant local Nuclear Insurance Pool and/or Association but only to the extent of the requirements of that local Pool and/or Association.
  4. The supply of goods and services to any of the sites, described in 1 to 3 above, unless such insurances shall exclude the perils of irradiation and contamination by Nuclear Material.

    Except as undernoted, Nuclear Energy Risks shall not include:

    1. Any insurance in respect of the construction or erection or installation or replacement or repair or maintenance or decommissioning of Property as described in 1 to 3 above (including contractors’ plant and equipment);
    2. Any Machinery Breakdown or other Engineering insurance not coming within the scope of (i) above.

    Provided always that such insurance shall exclude the perils or irradiation and contamination by Nuclear Material

    However, the above exemption shall not extend to:

    1. The provision of any insurance whatsoever in respect of:

      a. Nuclear Material;

      b. Any Property in the High Radioactivity Zone or Area of any Nuclear Installation as from the introduction of Nuclear Material or – for reactor installations – as from fuel loading or first criticality where so agreed with the relevant local Nuclear Insurance Pool and/or Association.

    2. The provision of any insurance for the undernoted perils:

      - Fire, lightning, explosion;

      - Earthquake

      - Aircraft and other aerial devices or articles dropped therefrom;

      - Irradiation and radioactive contamination;

      - Any other peril insured by the relevant local Nuclear Insurance Pool and/or Association.

    In respect of any other property not specified in 1 above which is directly involves the Production, Use or Storage of Nuclear Material as from the introduction of Nuclear Material into such Property.

DEFINITIONS:

Nuclear Material means:

  1. Nuclear fuel, other that natural uranium and depleted uranium, capable of producing energy by a selfsustaining chain process of nuclear fission outside a Nuclear Reactor, either alone or in combination with some other material; and
  2. Radioactive Products or Waste.

Radioactive Products or Waste means any radioactive material produced in, or any material made radioactive by exposure to the radiation incidental to the production or utilization of nuclear fuel, but does not include radioisotopes which have reached the final stage of fabrication so as to be usable for any scientific, medical, agricultural, commercial or industrial purpose.

Nuclear Installation means

  1. Any Nuclear reactor;
  2. Any factory using nuclear fuel for the production of Nuclear Material, or any factory for the processing of Nuclear Material, including any factory for the reprocessing of irradiated nuclear fuel; and
  3. Any facility where Nuclear Material is stored, other than storage incidental to the carriage of such material.

Nuclear Reactor means any structure containing nuclear fuel in such an arrangement that a self-sustaining chain process of nuclear fission can occur therein without an additional source of neutrons.

Production, Use or Storage of Nuclear Material means the production, manufacture, enrichment, conditioning processing, reprocessing, use, storage, handling and disposal of Nuclear Material.

Property means all land, buildings, structures, plant, equipment, vehicles, contents (including but not limited to liquids and gases) and all materials of whatever description whether fixed or not.

High Radioactivity Zone or Area means

  1. For nuclear power stations and Nuclear Reactors, the vessel or structure which immediately contains the core (including its supports and shrouding) and all the contents thereof, the fuel elements, the control rods and the irradiated fuel store; and
  2. For non-reactor Nuclear Installations, any area where the level of radioactivity requires the provision of a biological shield.

This Clause is subject otherwise to all terms and conditions of the Policy to which it is attached.

15. Sanction Limitation and Exclusion Clause

Insurer shall not be deemed to provide cover and shall not be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose that insurer to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions laws or regulations of the European Union, its individual member states (as far as applicable) or United States of America.

16. Electronic Data Clarification Agreement

Property damage covered under this Agreement shall mean physical damage to the substance of property.

Physical damage to the substance of property shall not include damage to data or software, in particular any detrimental change in data, software or computer programs that is caused by a deletion, a corruption to a deformation of the original structure.

Consequently, the following are excluded from this Agreement:

  1. Loss of or damage to data or software, in particular any detrimental change in data, software or computer programs that is caused by a deletion, a corruption or a deformation of the original structure and any business interruption losses resulting from such loss or damage. Notwithstanding this exclusion, loss or damage to data or software which is the direct consequence of insured physical damage to the substance of property shall be covered.
  2. Loss or damage resulting from an impairment in the function, availability, range of use or accessibility of data, software or computer programs and any business interruption losses resulting from such loss or damage.
17. Transmission and Distribution (T&D) Lines Exclusion Clause

All above ground transmission and distribution lines, including wire, cables, poles, pylons, standards, towers, other supporting structures and any equipment of any type which may be attendant to such installations of any description, for the purpose of transmission or distribution of electrical power, telephone or telegraph signals, and all communication signals whether audio or visual.

This exclusion applies to all equipment other than that which is on or within 300 metres (or 1000 feet) of an insured structure.

This exclusion applies both to physical loss or damage to the equipment and all business interruption, consequential loss, and/or other contingent losses related to transmission and distribution lines, other than contingent property damage/business interruption losses (including expenses), arising from loss and/or damage to lines of third parties.

18. Communicable Disease Endorsement
  1. This policy, subject to all applicable terms, conditions and exclusions, covers losses attributable to direct physical loss or physical damage occurring during the period of insurance. Consequently and notwithstanding any other provision of this policy to the contrary, this policy does not insure any loss, damage, claim, cost, expense or other sum, directly or indirectly arising out of, attributable to, or occurring concurrently or in any sequence with a Communicable Disease or the fear or threat (whether actual or perceived) of a Communicable Disease.
  2. For the purposes of this endorsement, loss, damage, claim, cost, expense or other sum, includes, but is not limited to, any cost to clean-up, detoxify, remove, monitor or test:

    1. For a Communicable Disease, or
    2. Any property insured hereunder that is affected by such Communicable Disease.
  3. As used herein, a Communicable Disease means any disease which can be transmitted by means of any substance or agent from any organism to another organism where:

    1. The substance or agent includes, but is not limited to, a virus, bacterium, parasite or other organism or any variation thereof, whether deemed living or not, and
    2. The method of transmission, whether direct or indirect, includes but is not limited to, airborne transmission, bodily fluid transmission, transmission from or to any surface or object, solid, liquid or gas or between organisms, and
    3. The disease, substance or agent can cause or threaten damage to human health or human welfare or can cause or threaten damage to, deterioration of, loss of value of, marketability of or loss of use of property insured hereunder.
  4. This endorsement applies to all coverage extensions, additional coverages, exceptions to any exclusion and other coverage grant(s).

All other terms, conditions and exclusions of the policy remain the same

19. Property Cyber and Data Exclusion
  1. Notwithstanding any provision to the contrary within this Policy or any endorsement thereto this Policy excludes any:

    1. Cyber Loss;
    2. Loss, damage, liability, claim, cost, expense of whatsoever nature directly or indirectly caused by, contributed to by, resulting from, arising out of or in connection with any loss of use, reduction in functionality, repair, replacement, restoration or reproduction of any Data, including any amount pertaining to the value of such Data;

    regardless of any other cause or event contributing concurrently or in any other sequence thereto.

  2. In the event any portion of this endorsement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.
  3. This endorsement supersedes and, if in conflict with any other wording in the Policy or any endorsement thereto having a bearing on Cyber Loss or Data, replaces that wording.
Definitions

Cyber Loss means any loss, damage, liability, claim, cost or expense of whatsoever nature directly or indirectly caused by, contributed to by, resulting from, arising out of or in connection with any Cyber Act or Cyber Incident including, but not limited to, any action taken in controlling, preventing, suppressing or remediating any Cyber Act or Cyber Incident.

Cyber Act means an unauthorised, malicious or criminal act or series of related unauthorised, malicious or criminal acts, regardless of time and place, or the threat or hoax thereof involving access to, processing of, use of or operation of any Computer System.

Cyber Incident means

  1. Any error or omission or series of related errors or omissions involving access to, processing of, use of or operation of any Computer System; or
  2. Any partial or total unavailability or failure or series of related partial or total unavailability or failures to access, process, use or operate any Computer System.

Computer System means any computer, hardware, software, communications system, electronic device (including, but not limited to, smart phone, laptop, tablet, wearable device), server, cloud or microcontroller including any similar system or any configuration of the aforementioned and including any associated input, output, data storage device, networking equipment or back up facility, owned or operated by the Insured or any other party.

Data means information, facts, concepts, code or any other information of any kind that is recorded or transmitted in a form to be used, accessed, processed, transmitted or stored by a Computer System.

20. Political Risks Exclusion Endorsement

Notwithstanding any provision to the contrary with this reinsurance or any endorsement thereto it is agreed that this reinsurance excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any of the following regardless of any other cause or event contributing or in any other sequence to the loss:

War, invasion, acts of foreign enemies, hostilities or warlike operations (whether war be declared or not), civil war, rebellion, revolution, insurrection, mutiny, civil commotion assuming the proportions of or amounting to an uprising, military rising, military or usurped power, martial law or state of siege or any of the events or causes which determine the proclamation or maintenance of martial law or stage of siege, confiscation, expropriation, nationalization, commandeering, requisition or destruction of or damage to property by order of the Government de jure or de facto or any public, municipal or local authority of the country or area in which the property is situated, seizure or destruction under quarantine or customs regulation.

This endorsement also excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to the above.

If the insurers allege that by reason of this exclusion, any loss, damage, cost or expense is not covered by this Policy, the burden of proving the contrary shall be upon the assured.

In the event any portion of this endorsement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

21. Fire Prevention and Appliances Clause

It is a condition precedent to any liability of the Company under this insurance that:

  1. The premises containing the insured property are fitted with the fire Extinguishing Appliances and that no withdrawal, alteration or variation of fire extinguishing appliances or any structural alteration which might affect the fire extinguishing appliances, shall be made without the consent of the company and it is warranted that the insured will maintain the fire extinguishing appliances in full working order during the currency of this Insurance.
  2. All other protections provided for the safety of the insured property shall be maintained in good working order throughout the currency of this Insurance and that these shall be maintained in full readiness for effective operation at all times.
  3. Immediate advice be given to the company of withdrawal of any Fire Extinguishing Appliance or any other protection.
  4. Storage of goods close to fire extinguishing hand appliances, emergency fire exits, and electrical switch/controls/fittings should be avoided by maintaining a clearance of at least 1 meter.
  5. Storage of goods near to walls and roof/ceiling should be avoided by maintaining a clearance of at least 1 meter.
  6. Storage of goods near doorways and passage should be avoided.
22. Civil Defence Warranty

Warranted the insured has complied with civil defence rules and regulations in respect of fire safety and firefighting equipment and have a valid civil defence certificate during the currency of the policy.

23. Hazardous Materials Warranty

Warranted that there be not in or upon within-mentioned premises at any time during the currency of this Policy hazardous goods as specified hereunder in excess of 1 per cent of the total value of the stock in or upon the said premises and in no case more than 6 gallons of motor spirit or other volatile spirits:

Acetylene (liquid), Barium Sulphide, Benzine, Benzoline, Bi-sulphide of Carbon, Bitumen, Brimstone 34nflamm, Calcium Carbide, Calcium Sulphide, Comphine, Camphor, Candles, Catridges, Celluloid, Xylonite & other similar substances, Charcoal (powdered), Chlorate of Potash, Chlorate of Soda, Chloride of lime, Cinematograph Films, Coconut and other Vegetable oils, Coir Yarn, Copper Sulphide, Copra, Copra Cake, Copra Meal, Cordite, Cotton (whether in fully pressed bales or otherwise), Crackers, Explosives of any kind, Fireworks, Fulminating powder, Ghee (Samneh) Grasses of all kinds, Gunny Bags (other than full pressed ironbound bales), Gunpowder, Hay, Hemp, Hessians (other than full pressed ironbound bales), Kerosene, Lampblack, Lime, Matches of any kind, Mungo, Naphtha, Nitric Acid, Nitrate of Soda, Nitro Glycerine, Oils (except lubricating oils not giving off an 34nflammable vapour below 350 deg. Fahr.) and/or Oil Paints, Paraffin, Percussion Caps, Petroleum and//or its liquid products (except lubricating oils not giving off an 34nflammable vapour below 350 deg. Fahr.), Petrol, Phosphorus, Picric Acid, Pitch, Potash, Pottassium Sulphide, Rags, Rockets, Rock Oil Saltpetre, Shoddy, Spirits of any kind not in bottles, Stearine, Straw, Sulphuric Acid, Sulphur Dyes or Colour excluding these packed in airtight metal vessel labelled with a certificate by the manufacturers that the dyes (or colours) contain at least 10 per cent of inert inorganic salts (Tallows Manufactured and Unmanufactured) Tar and/or tarred canvas, Turpentine, Varnish, Vegetable Fibres of any kind, waste of any kind.


EXTRA INFORMATION
BUILDINGS COVER
1. Sum Insured

The Sum(s) Insured must at all times represent the full cost of rebuilding to the same specification including demolition costs, architects and surveyors’ Fees.

2. Automatic Increase in Sum Insured

If applicable, the Sum Insured will be increased annually at each renewal date by a percentage calculated at Our discretion. Amended Sum(s) Insured and renewal premium will be shown on your renewal notice.

3. Excess

An amount of AED 1000 will be deducted from any claim under each of the BUILDINGS COVER of the Policy unless a specific excess has been mentioned for any Cover or in the Schedule.

In addition to the above, for any loss or damage in connection with Earthquake, Riot, civil commotion, strikes, labour disturbances, malicious persons or vandals, You will pay a special excess of 10% of the claim amount.

CONTENTS AND PERSONAL BELONGING COVER
1. Sum Insured

Sum(s) Insured must at all times represent the full cost of replacing the property insured without deduction for wear and tear and depreciation other than in respect of Carpets & Rugs Clothing, Household linen, Bikes/Pedal Cycles and electronics.

2. Automatic Increase in Sum Insured

If applicable and stated in the Schedule, the Sum Insured of Contents and Personal Belongings will be increased annually at each renewal date by the percentage calculated at Our discretion. Amended Sum(s) Insured and renewal premium will be shown on your renewal notice.

3. Matching items

(i) We will not pay for the cost of replacing any undamaged items forming part of a matching set, articles or suite of furniture. Where carpeting is damaged beyond repair, only the damaged carpet will be replaced and not undamaged carpet in adjoining rooms.

(ii) If any claim arises for loss of or damage to an article constituting one of an insured pair, no regard shall be had to any special value as such and the amount payable under this Policy shall be calculated as though the article had been separately insured at pro-rata of the value of the pair or set.

4. Excess

An amount as mentioned will be deducted from any claim under each of CONTENTS AND PERSONAL BELONGING COVERS of the Policy unless a specific excess has been mentioned for any Cover or in the Schedule.

In addition to the above, for any loss or damage to an item exceeding the Single Article Limit, You will pay 10% of the claim amount.

5. Change of Address

Subject to us being informed within fourteen days after removal to another address within the Geographical Limit and payment of any additional premium required, this Insurance shall continue to apply provided such new dwelling is built of brick, stone or concrete roofed with incombustible material is self-contained and not used for any business purpose.

6. Any Article Exceeding Single Article Limit

Proof of value will be required when making a claim for an item valued in excess of the Single Article Limit. We recommend that you retain copies of receipts, valuations, photographs, instructions booklets and guarantee cards to assist in the event of a claim. We require evidence that the item existed and is in your possession at the time of Policy purchase.

7. Recoverable Depreciation

In settling claims for total loss or damage beyond economic repair to Carpets & Rugs Clothing, Household linen, Bikes/Pedal Cycles and accidental damage to electronics, there will be a deduction for depreciation.

The following table specifies reduction in value for items specified above to determine the maximum indemnity that We are liable for.

Notification

Notify Us immediately after the occurrence of a claim, and provide all the information and assistance which we may reasonably require.

Upon your initial contact, We will ask some preliminary questions, documents required for the claim registration and to initiate the claim process.

You must provide all information or assistance we require and if the claim relates to a Third Party, you must not admit, deny or negotiate any claim without our written consent.

The Insured cannot dispose of any of the claimed items, and is responsible for keeping the damaged items available for survey (exception for perishable items such as food). No property may be abandoned to us.

Following your initial contact, We may require additional documents, according to the type of claim, we may request documents including but not limited to:

  • Police/Fire Report
  • Evidence relating to the incident
  • Evidence relating to the damaged property
  • Official documentation relating to the Insured or the item

If someone is making a claim against The Insured for any injury to them or damage to their property, The Insured must send us the full details, in writing, as soon as possible.

Any letters or documents The Insured receives should be sent to The Insurer, unanswered, without delay. Refrain from discussing liability with any third party. It is vital that The Insurer deals with the matter on The Insured's behalf.

Depending on the type of claim and value involved we may appoint a loss adjuster to verify and assess the amount of compensation that should be paid for the claim and manage The Insured’s claim on behalf of The Insurer.

Remedying Valid Claims

There are three main methods that we will use to remedy a customer’s losses: Repair, Replacement or Reimbursement.

We will have the final say in the outcome of all claims. The methods used to remedy all claims will be at our discretion

Repair

To remedy a claim via repair, the customer must provide us with copies of Invoices or receipts for their item, images of the damaged item along with a quote for repairs,

We require 1 quote from an authorised repairer, if there is no authorised repairer for the item, at least 3 quotes from a competent repairer to fix the damage caused.

For buildings, a quote from a competent tradesman or the preferred repairer of the building management company must be provided.

If the quote is reasonable and there are no issues with the claim, the customer will be given the go-ahead to arrange the repairs as per the agreed figures of the lowest quote.

We will only approve the costs of the repairs and do not arrange or authorise any repairs, it is left to the customer to decide if they wish to proceed with the repairs.

Once the repairs are concluded. The customer pays the full amount to the repairer and upon receipt of an invoice/receipt, We will reimburse the cost of the repairs minus any deductible, directly to the customer.

Replacement

In some cases, it may not be possible or economic to repair a loss. In these cases, we can look to replace the damaged item.

Where the item is damaged but not destroyed, we need the customer to send us images of the damaged item along with a quote for repairs.

We will then provide the customer with an offer of a replacement item that is like for like or as close to like for like if the item is discontinued. If the customer accepts the offer, we will instruct them to purchase the item and upon receipt of an invoice for the purchase, we will reimburse the agreed value less any deductible and depreciation if applicable.

If the item is over 12 months old/1 year old, our depreciation logic may be applicable to the settlement amount, depending on the type of claim.

Where the customer does not accept our replacement offer and elects for a different source, our settlement offer will be limited to the value of the replacement item we proposed, less any deductible.

If the item is destroyed or no longer in the policyholder's custody, i.e., through fire damage or violent theft, we will ask the policyholder to provide Invoices or receipts for their item and if they have a quote for a replacement item. This should be like for like or as close as possible.

We will then review the quote and unless we can source a better offer through our own partnerships, give the policyholder the go-ahead to purchase the item. As above, we will then seek an invoice for the purchase and settlement will be the agreed cost less deductible.

Depending on the type of loss and the age of the item, we will apply our depreciation logic which will be based on the age of the original item insured.

It may also be necessary to ask the customer to obtain a valuation of the lost or damaged items from a professional valuer to enable us to accurately quantify the value of the loss. Fees for the professional valuer have to be borne by the Policyholder.

If the claimed item(s) is/are a total loss, and the Company compensates the Insured on that basis, the salvage will be deemed property of the Company.

Cash Settlement or Settlement based on Indemnity

If a customer suffers a loss, does not wish to avail of repair or replace and wishes to be paid in cash for a loss, we can do this.

We will establish a cash value for the loss, if the original item was a total loss and depending on the type of loss, we may apply our depreciation logic. A further reduction applicable to Cash Settlement. The final Cash Settlement value will be at our discretion.

Additional Claims Information

The Insurer shall be entitled to:

  • Take over and conduct in your name the defence or settlement of any claim or
  • Prosecute in the Insured's name for our own benefit any claim for indemnity or damage or otherwise.

We shall have full discretion in the conduct of any proceedings and in the settlement of any claim

In respect of any claim or series of claims for which this policy indemnifies you against your legal liability we may at any time pay you:

  1. The limit of indemnity (after deduction of any sum(s) already paid as compensation) or
  2. Any lesser amount for which such claim(s) can be settled.

Once the payment has been made, The Insurer shall relinquish the conduct and control of and be under no further liability in connection with the claim(s) except for the payment of costs and expenses recoverable or incurred prior to the payment date.

Our aim is to deal with your claim promptly, efficiently and fairly. At all times we will try to provide you with the highest standard of service.
